General Terms and Conditions All Dried Fruits

Introduction

These general terms and conditions apply to all orders placed with All Dried Fruits. By placing an order, you agree to these terms and conditions .

Product Information

All our products and packagings are depicted as accurately as possible. However, slight variations in color, shape, or size may occur, as our products are natural. Packaging may also differ from the images displayed on our website or other communications.

Ordering Process

• Orders can be placed via our webshop or via email.

Pricing

• All listed prices are in euros and include VAT.

• Any applicable shipping costs are calculated separately and displayed during checkout.

Payment

Payment Terms and Methods

All Dried Fruits requires advance payment or immediate payment as the standard procedure for all customers. We offer the following secure payment methods:

• Bancontact

For business customers (such as hospitality, retailers, and partners), a credit period of up to 2 weeks is granted and will be mentioned on the invoice. For private customers (B2C), immediate payment is required.

Late Payment

1. For Consumers (B2C):

• A free written reminder will be sent with a 14-calendar-day payment term.

• If payment is not made within this period, we may:

  • Charge a fixed compensation fee in accordance with Article XIX.4 of the Belgian Economic Law Code:

    • €20 for an outstanding amount ≤ €150

    • €30 + 10% of the amount above €150 up to €500 for amounts between €150.01 and €500

    • €65 + 5% of the amount above €500, with a maximum of €2,000, for outstanding amounts above €500.

  • Apply late payment interest at the legal interest rate as determined in Article 5 of the Law of 02/08/2002.

  • Current rate: 12% per year (valid from 01/07/2023). The applicable legal rate at the time will be applied.

2. For Business Customers (B2B):

• Late payment interest of 12% per year from the invoice due date or the applicable legal rate.

• A fixed compensation fee of €40 for collection costs (Law of 02/08/2002).

• If one invoice is not paid, all outstanding invoices become immediately due and payable, regardless of the due date.

Delivery

• Delivery Time: Orders within the Benelux are typically shipped within 1-3 business days. For the rest of Europe, the estimated shipping time is 1 week. If goods are out of stock, we will notify immediately by e-mail.

• Shipping Costs: Calculated based on the total order amount and destination. 

• Risk Transfer: The risk of loss or damage transfers to the customer upon receipt of the order or upon delivery at a pickup point.

Return Policy & Right of Withdrawal

Right of Withdrawal

Consumers have the right to withdraw from their online purchase within 14 days of receipt without providing any reason.

Return Conditions:

• The goods must be in good condition and returned in their original, unopened packaging.

• If the packaging is not sealed, the full original weight of the product must still be present.

• If there are signs of use, contamination, moisture, or other irregularities, we reserve the right to reject the return or issue only a partial refund.

• Return Costs for Withdrawal: The customer is responsible for return shipping costs unless otherwise agreed.

• Return Costs for Defective or Incorrectly Delivered Products: All Dried Fruits will cover return costs and provide an appropriate solution (replacement or full refund).

 

Warranty

Food products are not covered by this legal warranty, but All Dried Fruits guarantees that all products comply with legal standards at the time of delivery.

Complaints & Dispute Resolution

• Complaints must be submitted in writing within 7 days of receipt via info@alldriedfruits.be.

• Disputes in Belgium fall under the jurisdiction of the Court of Gent. For disputes outside Belgium, a Belgian court will be designated.
